The consumer, acting as the buyer, enters into a sales contract with Tanja Nižić, Veslačka Ulica 4, 23 000 Zadar, Croatia, OIB: 10171491341, acting as the seller.
The user is a person who uses the website www.zadar-luxury-lofts.com, the same as any buyer and visitor of the website www.zadar-luxury-lofts.com.
The conclusion of a sales contract via the website www.zadar-luxury-lofts.com is regulated in accordance with legal provisions, taking into account in particular the principles and provisions of European Union directives. Conclusion of a contract via the website www.zadar-luxury-lofts.com constitutes distance selling.
These General Terms and Conditions also represent a pre-contractual notice and apply to the conclusion of a sales contract if the buyer is a consumer, i.e., any natural person who enters into a legal transaction or acts on the market outside their trade, business, craft, or professional activity, and if the contract is concluded between a trader and a consumer within an organized system of sales or provision of services without simultaneous physical presence of the trader and the consumer in one place, whereby until the conclusion of the contract and for the conclusion of the contract, exclusively one or more means of remote communication are used.
Means of distance communication are all means that can be used to conclude a distance contract without simultaneous physical presence of the trader and the consumer, such as the internet and electronic mail.
The contract is concluded when the seller accepts the buyer’s offer, and all information provided on the websites www.zadar-luxury-lofts.com constitutes an inTanjation to make an offer. The seller may terminate the sales contract if the buyer does not pay the purchase price, and is not obliged to deliver the product/service until the purchase price is received, except in the case when the buyer has chosen cash on delivery as the payment method.

The buyer is familiar with the main characteristics of the product/service on the website www.zadar-luxury-lofts.com. Tanja Nižić reserves the right to change information, including prices of products/services and promotional offers on the website without prior notice.
Along with the product image, there is a description of the main characteristics of the product/service and its price with VAT expressed in euros. Prices, payment terms, and promotional offers are valid only at the time of ordering and/or payment.
Procedure for concluding a contract
The purchase is made on the website of Tanja Nižić www.zadar-luxury-lofts.com by filling out the provided form. When filling out the form, the buyer is obliged to enter all the required information. The purchase can be made with the buyer’s confirmation that they have previously read and understood the General Terms and Conditions and agreed to them and that they are aware that this is an order with an obligation to pay. Purchase is possible 24 hours a day, 7 days a week. Tanja Nižić is not responsible for the costs of using computer equipment and telecommunication services necessary to access the service. The buyer will be notified by email of the order confirmation (receipt of an electronic message containing the buyer’s offer) and shipment dispatch.
If Tanja Nižić, for any reason, is unable to deliver any of the ordered products/services, an employee will contact the buyer by phone or e-mail to arrange delivery of a replacement product or possible cancellation of the ordered product/service. Purchase of products and/or services on behalf and for the account of minors or persons deprived of legal capacity (fully or partially) can only be requested by their legal representatives.
The purchase is made by ordering available products selected by the buyer based on the photograph and basic description. The purchase is made in several simple steps in the comfort of the buyer’s home, from any location in the world.
Product/service search is possible according to various criteria. The buyer can select a specific product/service of interest and read the available product description to independently decide if the product meets their needs. Ordering of products/services is done electronically. By clicking the mouse on the “Add to Cart” icon, the selected product is added to the cart. By placing the product in the cart, the product is not reserved, ordered, or purchased. The buyer can continue to add products by clicking on “Continue Shopping” or review the cart by clicking on “View Cart” or complete the product selection process by clicking on “Checkout”.
Once the customer completes the product selection process by clicking on ‘Complete Purchase,’ they will be redirected to a page where they enter the necessary delivery information, select the payment method, and add any additional notes if applicable. The purchase cannot proceed without checking the box ‘I agree to the General Terms and Conditions,’ by which the customer confirms that they have read and understood these General Terms and Conditions and agree to them, as well as by checking the box ‘I am aware that the order includes an obligation to pay.’ By clicking on ‘Edit Cart,’ the customer can modify the contents of the cart. If the customer agrees to purchase the products in the cart, they can click on the ‘Pay’ icon. Once the customer clicks on the ‘Pay’ icon to place the order, the seller will send the General Terms and Conditions along with the order confirmation to the customer’s email address, along with the order number confirming that the customer’s order has been received and is being processed.
If the customer does not receive a purchase confirmation via email within 72 hours or is unable to access the service as stated in the email, they must contact the seller at the email address zadar-luxury-lofts@gmail.com. In case Tanja Nižić is unable to deliver any of the ordered products/services for any reason, an employee will contact the customer by phone or email to discuss the delivery of a replacement product/service or the possible cancellation of the ordered product/service. Product/Service Price, Payment Method:
The customer agrees to pay for the ordered products using one of the following payment methods:
Credit or debit card – payment directly via the internet using card payment services: Amex, MasterCard, Maestro, Visa, and Diners.
Bank transfer – the necessary payment information, including the account number to which the customer should transfer the order amount, is sent to the email address provided during the order. The customer can make the payment using online banking or by payment at a bank branch, post office, FINA, etc. After receiving the payment, the ordered products are sent to the address indicated in the order.
The sales contract is concluded at the moment of acceptance of the buyer’s offer. The agreed purchase price includes all taxes and charges and is expressed in euros. Please note that the means of payment in the Republic of Croatia is the Euro.

The General Terms and Conditions that are provided to the customer via email in PDF format are binding for the customer.
Tanja Nižić reserves the right at any time and without prior notice to change, supplement, or terminate any part of its business, including the website or any part thereof, services, subpages, or services provided through them. This right includes but is not limited to changes in the availability of content, availability of new data, transmission methods, as well as the right to access or use the website.
The duty and obligation of users is to use the website in accordance with positive regulations and general moral and ethical principles. Right to unilateral contract termination:
The consumer may unilaterally terminate the contract within 14 days without stating a reason.
The 14-day period begins to run from the day the reservation is confirmed to the consumer or to a third party designated by the consumer.
If the consumer is not informed of the right to terminate the contract, the consumer’s right to unilateral contract termination expires 12 months after the expiration of the 14-day period.
If the seller notifies the consumer of the right to terminate the contract within 12 months, the right to unilateral contract termination expires 14 days after the consumer receives this notification.
For the consumer to exercise the right to unilateral contract termination, they must inform the seller of their decision to terminate the contract before the expiration of the 14-day period, using an unequivocal statement sent by mail to the address Tanja Nižić, address ________ or by email to zadar-luxury-lofts@gmail.com, in which they must provide their name, address, telephone number, or email address. The consumer may, at their discretion, use the sample form for unilateral contract termination attached below.
The seller will promptly provide the consumer with confirmation of receipt of the statement of unilateral contract termination to the physical address or email address. In the event of contract termination, each party is obliged to return to the other party what they received under the contract.
The seller is not obliged to refund any additional costs resulting from the consumer’s explicit choice of a type of transport other than the cheapest standard type of transport offered by the seller.
The seller must refund the payment using the same means of payment used by the consumer for payment, unless the consumer expressly agrees to another means of payment, and provided that the consumer is not obliged to pay any additional costs for such refund.
FORM FOR UNILATERAL CONTRACT TERMINATION
Notice of Written Consumer Complaint Procedure

In order for Tanja Nižić to respond to a written complaint that is not sent by email, consumers are requested to provide accurate information about their name and address to which the response will be delivered. Tanja Nižić must legally respond to the consumer’s complaint in writing no later than 15 days from the date of receipt of the complaint.
In the event of a dispute, Tanja Nižić and the consumer will resolve the dispute amicably, and if this is not possible, the competent Municipal Civil Court in Zagreb, applying Croatian law, will have jurisdiction. Dispute resolution is possible through mediation centers.
Consumer disputes can be resolved through the ODR platform of the European Commission.
